For the purposes of this Privacy Policy, “Personal Data” or “Personal Information” means any information that is linked or reasonably linkable to an identified or identifiable individual.

2. Information We Collect and the Sources of That Information

2.1 Information You Provide to Us

We collect Personal Information that you provide directly to us, for example when you create an account, complete a medical intake form, place an order or request treatment, contact customer support, or subscribe to communications. Depending on the products and services you use, this may include:

  • Name, shipping and billing address, telephone number, email address, and date of birth;
  • Health-related information you provide through the medical intake form or to our participating healthcare providers, such as medical conditions, medications and prescriptions, allergies, and other information needed to evaluate whether a prescription is appropriate;

  • Billing and payment information, such as your card number and billing address, which is collected and processed by our third-party, PCI-DSS-compliant payment processors on our behalf;
  • Records of your orders, transactions, and customer-service interactions;
  • Any other information you choose to provide to us in forms, email, chat, or other communications.

2.2 Information We Collect Automatically

When you use the Service, we and our service providers automatically collect certain information about your device and your use of the Service (“Usage Data”). This may include your Internet Protocol (IP) address, browser type and version, operating system and device identifiers, the pages you visit and the order in which you view them, the date and time of your visit, the time spent on pages, referring and exit pages, and similar diagnostic data.

Location information. We and our service providers may collect general location information (for example, the city, state, or postal code associated with your IP address) to help deliver relevant content and to apply correct sales tax where applicable.

2.3 Cookies and Similar Tracking Technologies

We use cookies, web server logs, tags, beacons, tracking pixels, and similar technologies to operate the Service, remember your preferences, understand usage, improve and analyze the Service, and deliver and measure content and advertising. Examples of the cookies we use include:

  • Session Cookies — used to operate the Service;
  • Preference Cookies — used to remember your preferences and settings;
  • Security Cookies — used for security purposes.

You can set your browser to refuse all or some cookies, or to alert you when cookies are being sent. If you do not accept cookies, some portions of the Service may not function properly. See your browser’s Help section for more information.

2.4 Information We Receive from Other Sources

We may receive additional information about you from third parties who work with us, such as participating physicians and healthcare providers, pharmacies, analytics providers, and marketing and advertising partners, and we may combine that information with information we collect through the Service.

3. How We Use Your Information

We use the information we collect for the following business purposes:

  • To provide, maintain, and improve the Service and support pharmacy and healthcare operations;
  • To process and fulfill your orders and requests for treatment, and to facilitate the telemedicine intake and review process with participating healthcare providers;
  • To verify your identity, administer your account, and process payments;
  • To communicate with you about your account, orders, and transactions, including order confirmations and shipping updates;
  • To provide customer support and respond to your questions and requests;
  • To send you newsletters, promotions, discounts, and information about products, services, and events that may be relevant to you (where permitted, and subject to your choices). These communications may originate from Medicine Counter Pharmacy or from affiliated platforms that support our services, including RightMD, which supports our telemedicine services. You may opt out at any time;
  • To analyze usage, conduct internal research, and improve the Service (published only in de-identified or aggregate form);
  • To detect, prevent, and address fraud, security issues, and technical problems;
  • To comply with applicable laws, regulations, and legal processes, and to establish, exercise, or defend legal claims.

We may aggregate or de-identify information so that it no longer reasonably identifies you, and we may use and share such aggregate or de-identified information for any lawful purpose.

4. Online Analytics and Advertising

4.1 Analytics

We use third-party analytics services, including Google Analytics, to help us understand how visitors use the Service. These services use cookies and similar technologies to collect usage information. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on available at https://tools.google.com/dlpage/gaoptout. For more information about Google’s privacy practices, see https://policies.google.com/privacy.

4.2 Advertising and Remarketing

We use remarketing and advertising services to show you advertisements on third-party websites and platforms after you have visited the Service. We and our third-party vendors use cookies and pixels to inform, optimize, and serve ads based on your past activity. Services we may use include:

You can also opt out of interest-based advertising from participating companies through the Digital Advertising Alliance at http://www.aboutads.info/choices, the Digital Advertising Alliance of Canada at http://youradchoices.ca, or the European Interactive Digital Advertising Alliance at http://www.youronlinechoices.eu. Opting out will not eliminate advertising, but it may make the ads you see less tailored to you.

5. How We Share and Disclose Your Information

We do not sell your Personal Information for money. We may share your information in the following ways:

  • Healthcare providers and telemedicine services — with participating, independent healthcare providers to evaluate your intake form, provide care, and issue prescriptions where appropriate, and to support treatment, payment, and healthcare operations at your request;
  • Service providers — with companies that perform services on our behalf, such as payment processing, order fulfillment and shipping, hosting and IT security, analytics, marketing and advertising, and customer support. These providers may access your information only to perform tasks on our behalf and are obligated not to use it for any other purpose;
  • Advertising partners — as described in the “Online Analytics and Advertising” section above;
  • Legal and safety — when we believe in good faith that disclosure is necessary to comply with a legal obligation or valid request by a public authority, to protect and defend our rights or property, to prevent or investigate possible wrongdoing, to protect the personal safety of users or the public, or to protect against legal liability;
  • Business transfers — in connection with, or during negotiations of, any merger, acquisition, financing, or sale of all or a portion of our assets, subject to applicable legal restrictions;
  • With your consent or at your direction — including testimonials or reviews you submit;
  • Aggregate or de-identified information — which may be disclosed for any lawful purpose.

6. Your Privacy Rights and Choices

Depending on where you live, you may have some or all of the following rights regarding your Personal Information:

  • The right to know the categories and specific pieces of Personal Information we collect, the sources of that information, and how we use and disclose it;
  • The right to access and receive a copy of your Personal Information in a portable format;
  • The right to correct inaccurate Personal Information;
  • The right to request deletion of your Personal Information, subject to legal exceptions (for example, information we are required to retain under pharmacy, healthcare, tax, or other laws);
  • The right to opt out of the “sale” or “sharing” of Personal Information for targeted advertising (see Section 7);
  • The right not to be discriminated against for exercising your privacy rights.

To exercise these rights, contact us using the details in the “Contact Us” section below. We will take steps to verify your identity before responding, and we will respond within the time required by applicable law. Certain information may be exempt from these rights where permitted by law.

7. Opt-Out of Sale/Sharing and Targeted Advertising

Some of the advertising and analytics activities described in this Privacy Policy such as allowing advertising partners to receive online identifiers, cookie data, or hashed contact information to deliver tailored ads may be considered a “sale” or “sharing” of Personal Information for “targeted advertising” under certain state privacy laws. You may opt out of this activity by:

  • Using the third-party advertising opt-out tools listed in Section 4;
  • Enabling a recognized browser-based opt-out preference signal, such as the Global Privacy Control (GPC), which we honor where required by law; and
  • Emailing us at help@gomedicinecounter.com to request that we stop using your email address for advertising audience matching.

8. Your Marketing and Communication Choices

8.1 Consent for Communication

By signing up, making a purchase, or otherwise interacting with us in person or through the website, you agree to receive promotional messages, order updates, and other notifications via SMS, email, or other communication channels.

8.2 Types of Messages We Send

  • Order confirmations, shipping updates, and transaction-related notifications;
  • Promotional offers, discounts, and new product or service announcements;
  • Important service updates, policy changes, or other necessary communications.

8.3 How to Opt Out

  • You may opt out of SMS messages at any time by replying STOP;
  • You may unsubscribe from marketing emails using the link in the email footer;
  • You may request removal from marketing communications by contacting customer support by email or phone.

Please note that even if you opt out of marketing messages, we may still send you operational or transactional messages related to your account and orders.

8.4 Message Frequency and Data Security

Message frequency depends on your order activity, promotional events, or urgent updates; we do not send excessive or spam-like messages. Your personal contact details are kept secure and are not shared with third parties for their own marketing without your consent.

9. Children’s Privacy

The Service is not directed to, and is not intended for, anyone under the age of 18 (“Children”). We do not knowingly collect Personal Information from anyone under 18. If you are a parent or guardian and believe your child has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from a child without verification of parental consent, we will take steps to remove that information.

10. Data Retention

We retain Personal Information for as long as necessary to fulfill the purposes described in this Privacy Policy, to provide the Service, and to comply with our legal, regulatory, tax, accounting, and pharmacy recordkeeping obligations. Because we are a pharmacy, certain prescription and health-related records must be retained for periods required by federal and state law. When information is no longer required, we take reasonable steps to securely delete or de-identify it.

11. Transfer of Data

Your information, including Personal Information, is processed and stored in the United States. If you access the Service from outside the United States, please be aware that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. Your submission of information constitutes your agreement to that transfer. We take steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

12. How We Protect Your Information

We implement technical and organizational measures designed to protect your Personal Information, including the use of secure connections and PCI-DSS-compliant payment processors for handling payment card data. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee its absolute security. Please keep your account password confidential, and be aware that information you share in public areas of the Service may be viewed by others.

13. Notice of Privacy Practices for Protected Health Information (HIPAA)

Because we provide pharmacy services, some of the information we handle is “Protected Health Information” (“PHI”) governed by the Health Insurance Portability and Accountability Act (“HIPAA”) and applicable state health-privacy laws. This section describes how PHI may be used and disclosed and your rights regarding your PHI. We are required by law to maintain the privacy of PHI, to provide this notice, and to abide by its terms.

13.1 How We May Use and Disclose PHI

  • Treatment — to provide, coordinate, and manage your care, including sharing PHI with the participating healthcare providers and prescribers involved in your care;
  • Payment — to obtain payment for services, including billing and processing of your orders;
  • Healthcare Operations — for quality improvement, licensing, audits, and other operations permitted by law;
  • As Required by Law — and for public health and safety, health oversight activities, judicial and administrative proceedings, and law enforcement, where permitted or required.

13.2 Your Rights Regarding PHI

  • To inspect and obtain a copy of your PHI (reasonable fees may apply);
  • To request an amendment of PHI you believe is incorrect or incomplete;
  • To request an accounting of certain disclosures;
  • To request restrictions on certain uses and disclosures (we are not required to agree to all requests);
  • To request confidential communications (how and where we contact you);
  • To receive a paper copy of this notice;
  • To be notified in the event of a breach of your unsecured PHI.

13.3 Complaints

If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer using the contact details below, or with the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint. Electronic transmissions of PHI subject to HIPAA use SSL/TLS encryption or an equivalent standard.

14. Privacy Notice for California Residents

If you are a California resident, you have specific rights under the California Consumer Privacy Act, as amended (the “CCPA/CPRA”), including the rights described in Section 6 above. In the preceding 12 months, we may have collected the following categories of Personal Information: identifiers and contact information; commercial and transaction information; financial information (collected by our payment processors); internet and network activity; general geolocation information; demographic information; health-related information you provide; and customer-service records.

We do not sell Personal Information to third parties for monetary payment, and we do not share Personal Information with third parties for their own direct marketing purposes (“Shine the Light”). Working with advertising and marketing partners may be considered a “sale” or “sharing” under the CCPA/CPRA due to the use of online identifiers; you may opt out as described in Section 7. To exercise your California rights, email help@gomedicinecounter.com and include your full name, email address, and the residential address associated with your use of the Service. We will verify your identity before responding and will not discriminate against you for exercising your rights.

15. Third-Party Links

The Service may contain links to websites and services that we do not operate. If you click a third-party link, you will be directed to that third party’s site. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We encourage you to review the privacy policy of every site you visit.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will post the updated Privacy Policy on this page and update the “Last Updated” date above. Where required by law, we will provide additional notice. Your continued use of the Service after changes become effective constitutes acknowledgment of the updated Privacy Policy.

17. Telemedicine and Prescription Services

Where you request Prescription Medication, you must complete the medical intake form. Upon completion, Medicine Counter Pharmacy will submit it to a participating Healthcare Provider. If the Healthcare Provider determines, after performing the requisite telemedicine services, that Prescription Medication is suitable for you, your order will be processed.

By purchasing any prescription medication from Medicine Counter Pharmacy, you confirm that you are a resident of the State of Tennessee. You acknowledge that you will either pick up your prescription from the pharmacy in person or have it shipped solely within the State of Tennessee.

Please be advised that Medicine Counter Pharmacy does not itself provide the telemedicine services; they are made available by third-party Healthcare Providers. The terms and conditions of any prescription made available through the telemedicine services are determined by the applicable Healthcare Provider(s). You understand and agree that Medicine Counter Pharmacy and its third-party healthcare providers shall not be liable for any treatment decisions or medication offered through telemedicine services.

18. Compounded Semaglutide / Tirzepatide

By using our services and making a purchase, you acknowledge and agree that all treatments, services, and purchases provided by Medicine Counter Pharmacy are non-refundable, non-returnable, and non-cancellable. Once an order is placed, the pharmacy will not be able to cancel or refund it. We are not responsible for delays caused by technical issues or shipping companies. All sales are final. Medicine Counter Pharmacy will not bill any form of insurance for Semaglutide/Tirzepatide, and the patient and patient’s representative agree that they will not seek any reimbursement from Medicine Counter, its employees, or third-party healthcare providers.

You acknowledge that Semaglutide/Tirzepatide, compounded in accordance with the prescriber’s instructions based on individual medical needs and BMI, is intended for specific medical conditions and should be used only as directed by your healthcare provider. You agree to adhere to the prescribed dosage and usage instructions, to contact Medicine Counter Pharmacy and your primary care provider if any side effect worsens, and to call 911 and seek immediate medical care in the case of any serious side effects or allergic reactions.

By accessing and using our services, you acknowledge that Medicine Counter Pharmacy and its associated providers have the authority to prescribe and dispense compounded Semaglutide/Tirzepatide at your request. On behalf of yourself, the patient, and your respective heirs and personal representatives, you indemnify Medicine Counter Pharmacy and all individuals associated with it against any and all claims arising from your voluntary request to receive Semaglutide/Tirzepatide. Medicine Counter Pharmacy reserves the right to refuse and refund any orders at its discretion.

19. Refund and Return Policy

Due to strict federal and state regulations, as well as safety concerns, all medication products sold by our pharmacy are considered final sale. This means that once an order is placed, it cannot be returned or refunded. These policies are in place to ensure the safety, integrity, and proper handling of all pharmaceutical products.

  • Final Sale: All medication purchases are final. We are unable to accept returns or provide refunds once the order is placed.
  • Regulatory Compliance: Our no-return and no-refund policy for medications is mandated by health and safety regulations, to prevent risks associated with reselling or reusing medications that may have been tampered with or improperly stored.
